A second precondition for the applicability of the civil limb of Article 61 is that the outcome of the dispute2 will be directly decisive of the relevant right or obligation3. Preliminary proceedings, such as those concerned with the grant of an interim measure, will fall within Article 6 where the right or obligation at stake in the preliminary and main proceedings is civil in nature and the interim measure effectively determines the right or obligation notwithstanding the length of time it is in force
