Proceedings and penalties which are non-criminal or which are not contingent upon a criminal conviction or sentence fall outside the protection of Article 71. These include: internment2; preventative detention3; civil bankruptcy proceedings4; confiscation orders relating to the proceeds of crime5; proceedings for non-compliance with building regulations6; a fine for behaviour in court after proceedings had been adjourned7; a disqualification order preventing the appellant working with children for an indefinite period
