613. Negative right limited in scope.

Although education plays an indispensable and fundamental role in a democratic society1 the European Convention on Human Rights does not guarantee it, instead expressing the right in the negative sense of being a right not to be denied it2. The right is therefore limited in scope3, and does not include a number of rights such as a right to education of a particular kind or quality, a right to education at or by a particular institution, or a general right not to be expelled on disciplinary grounds
