The right to form or join a trade union includes the right of trades unions to draw up their own rules, administer their own affairs and establish and join trade union federations1. It applies equally to state employees2, but does not extend to a right to positive protection by prison authorities to protect the association rights of prisoners3. The right to join a trade union does not amount to a right for a person to join a union of their choosing irrespective of the rules of that union: unions are free to decide questions concerning admission and expulsion, and
