A person who has been committed to custody1 by a magistrate to await the outcome of a request for his return to another state has a right to apply for a writ of habeas corpus for the purpose of testing the validity of his committal2. An alien who is being held in custody pending deportation may challenge the lawfulness of the detention by way of habeas corpus
