Extradition must not be ordered to a territory if a person could be, will be, or has been sentenced to death for the offence in the territory1, although if the Secretary of State receives a written assurance which he considers adequate that a sentence of death will not be imposed or will not be carried out if it is imposed, extradition can be ordered
