Article 81 does not guarantee the right to a clean or quiet environment, but may be engaged in cases of sufficiently serious environmental nuisance2 or pollution3 that have a significant impact upon the ability of an individual to enjoy their private life, their family and/or their home4. Article 8 also guarantees certain procedural rights and rights of participation in relation to decisions affecting the environment
