Article 51 may engage positive obligations on the part of the state so as to require the taking of effective measures to safeguard against the risk of disappearance of a person in its custody and to conduct a prompt effective investigation where there is an arguable claim that a person has been taken into state custody and has since disappeared2: however contracting states are not under a duty to investigate every arguable claim that a person had been unlawfully detained
