The duty of the state to put in place a legislative and administrative framework designed to provide effective deterrence against threats to the right to life1 includes effective criminal law provisions to deter the commission of offences against the person backed up by law-enforcement machinery for the prevention, suppression and sanctioning of breaches of such provisions2. Article 2 does not as such guarantee a right to have criminal proceedings instituted against third parties
