Where Article 51 is engaged in cases involving the detention or restraint of a child the court must consider whether the cumulative effect of the restraint amounts to a deprivation of liberty2. It is not a violation of Article 5 for a parent to make a decision to restrict the liberty of a child against the child's wishes provided there is no bad faith on the part of the parent
