There is no requirement under Article 71 that an individual must be sentenced on the basis of his age at the commission of the offence, rather than at the date of conviction, provided that the offence in question meets the requirements of legal certainty and foreseeability2. However, where a relevant age threshold is crossed between the commission of an offence and conviction, the starting point is the sentence most likely to have been imposed at the time of commission
