430. Admission or expulsion of non-nationals.

Subject to the particular provision made in respect of EEA nationals and their families1, a state has the right to control the entry of non-nationals into its territory and the extent of its obligation to admit to its territory relatives of settled immigrants will vary according to the particular circumstances of the persons involved and the general interest2. Article 8 is not automatically violated if the family member is refused access to, or removed or expelled from, the state in which other members are lawfully resident
