802. Names.

There is no property in a name as such, and consequently, in the absence of malicious intention1 or misrepresentation, a person has a right to use his own name or adopt another name for himself2 or his property3 as he pleases, even though inconvenience or annoyance may be caused.

By use of a particular name in connection with a business or profession, whether the name is that of the user or is an adopted name, a right to prevent another person from using that name in a manner liable to cause confusion in the mind of the public may, however,
