849. Dispossession without consent.

An act by which a possessor of goods is deprived of his possession without his consent may be legally justifiable or wrongful according to circumstances1. It is rightful or justifiable, for example, when the true owner retakes them from a trespasser2, or when the taking is authorised by law, for example by statute3 or in a case of public necessity or as being for the true owner's benefit
