(1) the Pensions Regulator1 is of the opinion that in relation to a scheme ('the initial scheme') in relation to which the statutory provisions as to contribution notices2 apply: (a) a specified act or failure to act3 has occurred (or first occurred) at any time; and (b) the other statutory conditions for issuing a contribution notice are met in relation to the initial scheme (or, but for any transfer falling within head (2), would be met); and
(2) the accrued rights4 of at least two persons who were members of the initial scheme are transferred5 at that or
