References in the subsisting rights provisions1 to the actuarial equivalence requirements, in respect of a detrimental modification2 which is not a protected modification3, are to be read in accordance with the following4 provisions5. The actuarial equivalence requirements apply in the case of an affected member6 only if: (1) the modification is not a protected modification; and (2) the trustees of the scheme determine that they are to apply in his case7.
