Regulations1 may provide that where the Board of the Pension Protection Fund2 is satisfied that an eligible scheme3 was not such a scheme throughout such period as may be prescribed4, the Board must refuse to assume responsibility5 for the scheme6. Where7 the Board is required to refuse to assume responsibility for a scheme, it: (1) must issue a notice to that effect (a 'withdrawal notice'); and (2) give a copy of that notice to: (a) the Pensions Regulator8; (b) the trustees or managers9 of the scheme; and (c) any insolvency practitioner10 in relation to the employer11 or, if there
