Formerly, if an annuitant was also a personal representative, he had the right to retain the amount of all arrears owing to him in respect of his annuity1. However, this right was abolished as from 1 January 19722. If the estate is insolvent, a personal representative must now prove for the value of his annuity like an ordinary creditor
