Special provision as to the rule against perpetuities is made by the Perpetuities and Accumulations Act 2009 for relevant pension schemes. In respect of instruments taking effect on or after 6 April 20101, the rule does not apply to an interest or right arising under a relevant pension scheme2. This exception, however, does not apply if the interest or right arises under: (1) an instrument nominating benefits under the scheme; or (2) an instrument made in the exercise of a power of advancement arising under the scheme3.
