In the case of deaths on or after 29 December 19861, the law is laid down by the Insolvency Act 19862 and orders made under that Act3.
In most cases, administration of the insolvent estate will be carried out by the personal representatives out of court, but it may also be carried out under the direction of the court in administration proceedings, or in bankruptcy following an insolvency administration order made by the bankruptcy court
