323. Powers to modify, and consultations about, regulations.

Regulations1 may modify2 any provisions of Part I of the Pensions Act 19953, in their application:


    (1)     to a trust scheme4 which applies to earners5 in employments6 under different employers7;


    (2)     to a trust scheme of which there are no members8 who are in pensionable service9 under the scheme10; or


    (3)     to any case where a partnership is the employer, or one of the employers, in relation to a trust scheme11.

Before the Secretary of State12 makes any regulations by virtue of that Part, he must consult such persons as he considers appropriate13; but this does not apply:
