Where the court has power1 to order a party to a marriage2 or civil partner to pay a lump sum to the other party or partner and the benefits which the party or partner with pension rights3 has or is likely to have under a pension arrangement4 include any lump sum payable in respect of his death, the court also has power to order any of the following5:
(1) if the person responsible for the pension arrangement6 in question has power to determine the person to whom the sum, or
