The following provisions1 apply in relation to an occupational pension scheme2 other than: (1) a money purchase scheme3; or (2) a prescribed scheme or a scheme of a prescribed description4. The Pensions Regulator5 may issue a financial support6 direction under these provisions in relation to such a scheme if the Regulator is of the opinion that the employer7 in relation to the scheme: (a) is a service company8; or (b) is insufficiently resourced9, at a time determined by the Regulator which falls within a specified provision10) ('the relevant time')11.
