In prescribed1 circumstances, the Secretary of State2 may provide information to any prescribed person in connection with the following questions:
(1) whether an individual who during any period:
(a) has been eligible to be an active member3 of an occupational pension scheme4 under the Superannuation Act 19725; but
(b) has instead made contributions to a personal pension scheme6,
(2) has suffered loss as a result of a contravention of rules made under the Financial Services Act 1986 or under the Financial Services and Markets Act 2000 which is actionable7; and
(3) if so, what payment would need to be
