In a case to which the statutory requirement to make arrangements for internal dispute resolution applies1, the Pensions Ombudsman2 must not investigate or determine a complaint3 or dispute4 concerning an occupational pension scheme unless written notice of a decision in respect of that complaint or dispute has first been issued by the trustees or managers of the scheme under the arrangements required by statute5 or unless, where an application concerning a complaint or dispute has been made to an occupational pension scheme under the required arrangements, he is satisfied that:
(1) there is no real prospect of a notice
