(1) the Pensions Regulator1 determines to make a winding up order2 in relation to a pension scheme ('a winding up order');
(2) that determination is made during the period for which a freezing order has effect3 in relation to the scheme;
(3) the case is not one to which the special procedure for immediate exercise of powers where there is an immediate risk to assets applies4; and
(4) the winding up order accordingly cannot be made until the expiry of the period specified where a determination is referred to a tribunal5,
