299. Duties of trustees, employers and scheme administrators.

The trustees of an occupational pension scheme1 are bound to observe the principle of equal treatment2, in the exercise of their powers and the performance of their obligations as laid down in the trust deed3. In so far as national law prohibits employers and trustees from acting beyond the scope of their respective powers or in disregard of the provisions of the trust deed, they are bound to use all the means available under domestic law, such as recourse to the national courts, in order to eliminate all discrimination in the matter of pay
