If a jobholder1 is an active member of a qualifying scheme2, the employer3 must not take any action, or make any omission, by which (without the jobholder ceasing to be employed by the employer): (1) the jobholder ceases to be an active member4 of the scheme; or (2) the scheme ceases to be a qualifying scheme5. This requirement is not contravened if the jobholder remains an active member of another qualifying scheme
