381. Circumstances in which the preservation requirements apply.

Provision has been made for the preservation of benefit under occupational pension schemes1 whose resources2 are derived in whole or in part from:

  1.  

    (1)     payments made or to be made by one or more employers3 of earners to whom the scheme4 applies, being payments either:

    1.  

      (a)     under an actual or contingent legal obligation; or

    2.  

      (b)     in the exercise of a power conferred, or the discharge of a duty imposed, on a minister of the Crown, government department or any other person, being a power or duty which extends to the disbursement or allocation of public money5; or
