735.     Choice of remedies.

Where the annuity1 is secured by a covenant, the annuitant may bring a claim on the covenant2. He may also in a proper case obtain the appointment of a receiver3. The High Court has a statutory jurisdiction to appoint a receiver by an interlocutory or final order in all cases in which it appears to the court to be just and convenient to do so4.

Where the annuity is charged on land, the annuitant is also, as against the land, able to avail himself of the statutory remedies
