The following provisions1 apply where in relation to an occupational pension scheme2: (1) the Board of the Pension Protection Fund3 determines4 not to approve a notice issued5 by an insolvency practitioner6 or former insolvency practitioner in relation to the employer7; or (2) an insolvency practitioner or former insolvency practitioner in relation to the employer fails to issue a notice8 and the Board is satisfied that such a notice ought to have been issued9. The obligations on the insolvency practitioner or former insolvency practitioner10 are to be treated as obligations imposed on the Board and the Board must accordingly issue
