138. Determination of appropriate statutory period.

The question of which is the appropriate period1 for which accumulation is validly directed is a question of construction of each instrument2. That period is not necessarily the longest, nor the one which may best effectuate the intention to accumulate, but it is the one that actually fits the intention as declared by the instrument3. The court has to determine which of the permitted statutory periods the maker of the instrument has seemingly selected, determining the question by reference to the language employed and the facts of the case
