An actionable infringement may be committed from the date of publication of the application1 until the expiration of the term of the patent2, but no action for infringement may be commenced until the patent is granted3. An act done before the patent is granted4 will infringe only if it infringes both within the scope of the monopoly of the patent as granted and also within the scope of the claims5 contained in the application as first published6.
