Where the right in a registered design (other than an international registration)1 has expired by reason of a failure to extend2 the period for which the right subsists, an application for the restoration of the right in the design may be made to the registrar3 within the period of 12 months beginning immediately after the date on which the right in the registered design expired4. The application may be made by the person who was the registered proprietor5 of the design or by any other person who would have been entitled to the right in the design if it
