Where at any time before a patent has been granted1 for an invention2 a person refers a question relating to his entitlement to a patent for it3, the comptroller4 must determine the question and may make such order as he thinks fit to give effect to that determination5. In particular, where the reference is made between the filing of an application6 for a patent and the grant of a patent pursuant to the application, the comptroller may7:
(1) order that the application is to proceed in the name of the person
