521.     Questions arising on an alleged infringement.

The question of infringement of a patent involves consideration of two matters. The first is whether the article or process alleged to infringe falls within the scope of the monopoly granted by the patent; and the second is whether the alleged infringer has done, in relation to that article or process, any act the monopoly in which is given by a patent to its proprietor1.
