At any time after the expiration of three years, or of such other period as may be prescribed, from the date of the grant of a patent1, any person may apply to the comptroller2 for compulsory licensing3 on one or more of the following grounds:
(1) in the case of an application made in respect of a patent whose proprietor is a WTO proprietor4, the relevant grounds are5:
