Until IP completion day1, an application may be made to the community design court2:
(1) for an order that an infringing article3 or other thing delivered up in pursuance of an order4 must be forfeited to the holder of the community design5 or destroyed or otherwise dealt with as the court may think fit6; or
(2) for a decision that no such order should be made7.
In considering what order, if any, should be made, the court must consider whether other remedies available in an action for infringement of the right in a community design would be adequate to compensate
