Anything which consists of the following is declared not to be an 'invention' (and therefore not patentable) for the purposes of the Patents Act 1977 and the European Patent Convention1:

    (1)     a discovery, scientific theory or mathematical method2;

    (2)     an aesthetic creation3;

  3.  

    (3)     a scheme, rule or method for performing a mental act4, playing a game or doing business, or a program for a computer5; and
