An applicant for a patent has, as from the publication of the application1 for the patent until grant2, the same right as he would have had, if the patent had been granted on the date of publication, to bring proceedings for damages for infringement3. The applicant is, however, entitled to bring proceedings in respect of any act only:
(1) after the patent has been granted4
