316.     Conversion of European patent applications.

The comptroller1 may direct that, on compliance with the relevant conditions, an application for a European patent (UK) is to be treated as an application under the Patents Act 1977 where the application is deemed to be withdrawn under the provisions of the European Patent Convention relating to the time for forwarding applications to the European Patent Office2.

The relevant conditions are:


    (1)     that the applicant requests3 the comptroller within the relevant prescribed period4 (where the application was filed with the UK Intellectual Property Office5) to give a direction under these provisions6,
