Where there are no proceedings pending1 before the court2 or the comptroller3 in which the validity of the patent may be put in issue4, the comptroller, on application made by the proprietor of the patent5, may allow the specification6 of the patent to be amended, subject to such conditions, if any, as he thinks fit7. There is no power to entertain such an application made while any such proceedings are pending8, and an amendment allowed upon such an application would be invalid9.
