If there is no agreement that the interest of an outgoing partner may be purchased, or if the terms of such an option are not complied with1, and the remaining partners carry on the business of the firm2 with its capital or assets without any final settlement of accounts as between the outgoing partner or his estate, the outgoing partner or his estate has the option of taking either interest at 5 per cent per annum on the value of his share of the assets
