If a partnership agreement permits a partner to nominate his successor on his death or retirement1, the firm comes under an obligation to admit the nominee as a partner2, but cannot compel him to become a partner3. Even if one partner has covenanted with another that his nominee is to become a partner with the other, the court will not specifically enforce the covenant against the nominee; and, if no provision has been made for the event of his refusal to become a partner, the partnership will be declared dissolved, but without prejudice to any right of action which
