Subject to any agreement between the partners, a partnership is dissolved as regards all the partners by the death of any partner1. If a partner gives a valid notice of a dissolution but dies before the receipt or the expiration of the notice, the partnership is dissolved by the death and not by the notice2.
Unless the partnership agreement otherwise provides, neither the surviving partners nor the personal representatives of a deceased partner are entitled or bound to continue a partnership, even if the partnership term is unexpired at the time of the death
