314.     Origin of greens.

A green cannot arise at common law (either by prescription or grant1) but only by custom or statute2. Traditional greens arose from custom3. Many greens have been created by statute under an Inclosure Act or a local municipal or similar Act4. By statute5 it is possible to register a green after 20 years' use6. It is also now possible for the owner of land voluntarily to dedicate it as a green7.
