A person, other than an authority1 acting in the exercise of its functions, who without reasonable excuse2:
(1) intentionally or recklessly destroys or damages any of the flora, fauna, or geological or physiographical features by reason of which land3 is of special interest, or intentionally or recklessly disturbs any of those fauna4; and
(2) knew that what he destroyed, damaged or disturbed was within a site of special scientific interest5,
is guilty of an offence6.
