Certain functions that fall to be performed by or through the Department for Environment, Food and Rural Affairs or the Department for Business, Energy and Industrial Strategy ('DEFRA or BEIS functions')1 may be delegated.
The Natural Environment and Rural Communities Act 2006 provides that the Secretary of State may enter into an agreement with a designated body2 authorising that body to perform a DEFRA or BEIS function:
(1) either in relation to the whole of England or in relation to specified areas in England;
(2) subject to head (1), either generally or in specified cases3.
Such an agreement may be cancelled
