Smoke1 emitted2 from premises3 so as to be prejudicial to health4 or a nuisance5 constitutes a statutory nuisance6, except where:
(1) the smoke is emitted from a chimney7 of a private dwelling8 within a smoke control area9;
(2) it is dark smoke10 emitted from a chimney of a building or a chimney serving the furnace of a boiler or industrial plant attached to a building or for the time being fixed to or installed on any land11;
(3) it is emitted from a railway locomotive steam engine12;
(4) it is dark smoke emitted otherwise than as mentioned in head
