Some nuisances are a continuing source of harm for which the creator remains responsible1. In such cases the nuisance gives rise to a fresh cause of action as often as fresh damage is caused2. All actions for nuisance are statute-barred if brought more than six years after the cause of action for the damage complained of arose3, except that where the damages claimed consist of or include damages in respect of personal injuries the period of limitation is three years4.
